CORESOUTH, LLC (dba CoreSouth Lagree)

These Terms do not require a signature. You accept them by using this Site, by purchasing from CoreSouth, or by signing the CoreSouth Membership and Purchase Agreement, which incorporates them by reference. The version in effect on the date you accept is the version that applies to you; CoreSouth retains dated copies of prior versions and will provide one upon request.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the CoreSouth Lagree website, online booking tools, and related digital services (collectively, the "Site"), operated by CoreSouth, LLC, CoreSouth Madison, LLC, and CoreSouth Guntersville, LLC ("CoreSouth," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. What These Terms Cover, and What They Do Not

These Terms govern your use of the Site. They do not govern your purchase of a membership, class package, or other service from CoreSouth. Those purchases are governed by the CoreSouth Membership and Purchase Agreement, which you sign at the time of purchase and which contains the terms covering billing, membership length, automatic renewal, cancellation, and refunds.

Order of precedence. In the event of any conflict between these Terms and the Membership and Purchase Agreement regarding memberships, billing, renewal, cancellation, or refunds, the Membership and Purchase Agreement controls. Participation, safety, conduct, and recording are governed by the Client Liability Waiver.

3. Changes to These Terms

We may modify these Terms at any time. Changes take effect when posted to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

4. Eligibility and Accounts

You must be at least sixteen (16) years of age to participate in CoreSouth classes, and any participant under nineteen (19) years of age must have a parent or legal guardian sign on their behalf. You must be at least nineteen (19) years of age to purchase a membership online. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

5. Booking and Scheduling

Class reservations made through the Site and or CoreSouth Lagree Application are subject to availability, capacity limits, and CoreSouth's booking, late cancellation, and no-show policies. CoreSouth does not guarantee a reservation in any particular class, at any particular time, at any location, or with any particular instructor, and may add, modify, rename, combine, relocate, or discontinue class types, formats, schedules, hours, and instructor assignments at any time.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, video, audio, class descriptions, and software, is the property of CoreSouth or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and download Site content for your own personal, noncommercial use only. Any other use, including reproduction, modification, distribution, republication, public display, or creation of derivative works, requires our prior written permission. CoreSouth's class programming, methodology, and choreography are proprietary and may not be reproduced, taught, or commercialized without written permission.

7. Prohibited Conduct

You agree not to:

  • Upload, post, or transmit any material that is unlawful, defamatory, harassing, abusive, obscene, threatening, or infringing on the rights of others.

  • Transmit any virus, malware, or other harmful code, or attempt to gain unauthorized access to the Site, Application or any account.

  • Make false or misleading statements, impersonate any person, or misrepresent your affiliation with any person or entity.

  • Use automated means to scrape, crawl, or harvest data from the Site.

  • Use the Site for any commercial purpose without our written permission, or in any way that interferes with its operation.

8. User Submissions

If you submit reviews, comments, photos, testimonials, or other content to us or to our social media channels, you grant CoreSouth a nonexclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content in connection with our business. You represent that you own or have the rights to any content you submit and that it does not infringe the rights of any third party.

9. Third-Party Services and Links

The Site may contain links to, or be integrated with, third-party services including scheduling, payment processing, and analytics providers. We are not responsible for the content, policies, or practices of any third party. Your use of a third-party service is governed by that party's own terms and privacy policy.

10. Disclaimers

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the fullest extent permitted by law, CoreSouth disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or that any information on it is accurate, complete, or current.

Nothing on the Site constitutes medical, health, nutritional, or fitness advice. Consult a physician before beginning any exercise program.

11. Limitation of Liability

To the fullest extent permitted by Alabama law, CoreSouth shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the Site, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages. In no event shall CoreSouth's total aggregate liability arising out of or related to the Site exceed the greater of one hundred dollars ($100) or the amount you paid to CoreSouth in the six (6) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12. Indemnification

You agree to indemnify, defend, and hold CoreSouth harmless from any claim, liability, loss, damage, cost, or expense, including reasonable attorney fees, arising out of your use of the Site or Application, your breach of these Terms, or your violation of any law or the rights of any third party.

13. Communications

By providing your email address or mobile number, you consent to receive transactional communications from CoreSouth relating to your account, bookings, and purchases. Marketing communications, including promotional text messages, require your separate consent and can be withdrawn at any time. See our Privacy Policy for details.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in the State of Alabama, and you consent to the jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, Client Liability Waiver, and (where applicable) the Membership and Purchase Agreement, constitute the entire agreement between you and CoreSouth regarding the subject matter described.
